When a customer (the “Customer”) browses the website (the “Website”) of Laderach Japan Corporation (“Läderach Japan”), information about the Customer stored on his/her personal computer, smartphone or other device may be transmitted to Läderach Japan or third-party companies approved in advance by Läderach Japan (“External Transmission”). A technology called cookies may be used for External Transmission.

• for improving the convenience of the Customer, such as by retaining information entered by the Customer on the Website, login status and shopping cart information;

• for improving the convenience of the Customer, such as by remembering the layout, font size, settings, colors, etc. that the Customer has applied to the Website;

• for distributing advertisements tailored to the interests of the Customer based on his/her website browsing history and product purchase history, and analyzing the effects thereof;

• for suggesting recommended products based on the Customer’s website browsing history and product purchase history; or

• for operating and improving the products and services of Läderach Japan and planning new products and services based on the Customer’s website browsing history and product purchase history.

Läderach Japan uses advertising distribution services and behavior log analysis tools provided by third-party companies. When the Customer browses the Website, information about the Customer stored on his/her personal computer, smartphone or other device may be transmitted to the third party companies as shown in the table below.

Laderach Japan Corporation  (“Läderach Japan”) shall establish this privacy policy (this “Privacy Policy”) as follows with respect to the handling of personal information of all customers who use the shopping services provided on www.laderach.com/jp-jp and www.laderach.com/jp-en (the “Website”) managed and operated by Läderach Japan (the “Services”) and all those who provide personal information to Läderach Japan (including business partners of Läderach Japan; collectively, the “Customer”).
Meaning and interpretation of the terms used in this Privacy Policy are in accordance with the Act on the Protection of Personal Information of Japan (the “PPI Act”).

1. Customer contact information

Customer’s name, e-mail address, telephone number, and physical address

2. Information about creation of account and login

• Username, account ID, password, and answers to security questions

• Social media account information, personal information disclosed from the social media, etc. if the Customer makes a login through his/her social media account such as a Google account using social login function
  (Please note that the Customer is deemed to have agreed to disclose and share the personal information registered on the social media when he/she makes such social login.)

• language preferences, profile pictures, gender, age, hobbies, and interests that are voluntarily registered as account information

3. Information on transactions and payments

Transaction details, purchase history, credit card information, bank account number, other information concerning payment and method thereof, shipping address, and billing address [Midosuji: Correct the description above depending on the payment service used.]

4. Identifying information

Identity verification documents (i.e., a driver’s license, a health insurance card, a copy of a residence certificate, etc.) and information contained in said documents

5. Information to be acquired when using the Services

On-line identifiers such as Cookie, the Customer’s user terminal information, location information, browsing history, and other usage status of the Services (including access logs, IP addresses, browser information, OS information, browser’s language preferences, etc.)

• Läderach Japan will acquire and use personal information of the Customer within the scope of the following purposes of use (the “Purpose of Use”):

• to enable the Customer to create an account, make a login, and use the Services;

• to provide the Customer with goods and services;

• to invoice the price of the goods, etc.;

• to provide, solicit, advertise, and conduct other marketing activities for Läderach Japan’s goods and services on its media, in accordance with the Customer’s interests based on the analysis of information such as his/her browsing history and purchase history;

• to send newsletters and mailing lists;

• to conduct campaigns, prize competitions, and questionnaires;

• to improve goods and services and to conduct planning, research and development of new goods and services;

• to prevent and address fraudulent acts; and

• to respond to inquiries and to contact the Customer.

• Läderach Japan will also acquire and use personal information of the Customer for services related to each of the above matters in “Läderach Group Companies” (meaning Läderach Japan, its parent company, and their subsidiaries or affiliates).

• In order for the Customer to log in to and use the Services, he/she is required to provide his/her personal information for the Läderach Group Companies’ use of it for the Purpose of Use. Please note that if the Customer does not agree to such use by Läderach Group Companies of his/her personal information, Läderach Japan may refuse the Customer’s use of the Services.

1. Läderach Japan will not provide any personal information handled by Läderach Japan to any third party without obtaining the prior consent of the Customer, except for the cases listed in the following items:

1. cases in which the provision is based on laws and regulations;

2. cases in which it is necessary for the protection of the life, body, or property of an individual and in which it is difficult to obtain the consent of the Customer;

3. cases in which it is particularly necessary for improving public health or promoting the sound growth of children and in which it is difficult to obtain the consent of the Customer;

4. cases in which it is necessary to cooperate with a state organ or a local government, or an individual or a business operator entrusted by either of them in executing the affairs prescribed by laws and regulations and in which obtaining the consent of the Customer is likely to hinder the execution of the affairs; or

5. other cases permitted by law.

2. Läderach Japan may entrust the handling of personal data to an external carrier or other third party to the extent necessary to achieve the Purpose of Use. In such case, Läderach Japan shall select a trustee that can handle personal data appropriately, enter into an agreement concerning the handling of personal data with the trustee, and exercise necessary and appropriate supervision over the trustee.

3. Läderach Japan may provide personal data of the Customer obtained by itself to Läderach Group Companies in foreign countries (the ones located in Switzerland, the U.S., Canada, United Kingdom and the member states of EU) and third parties in foreign countries as follows.

1. Copyright to any and all images, text, audio, video, programs, or other information on the Website (the “Content”) shall belong to Läderach Japan. However, if copyright holders other than Läderach Japan exist, the copyright of the Content shall, in principle, belong to the respective authors.

The Customer is strictly prohibited from using the Content without permission of the respective copyright holders beyond the scope permitted by the Copyright Law, such as for private use (including but not limited to duplication, alteration, or use on other websites, on social networking services, or in printed material).

2. The names of the products of Läderach Japan shown on the Website shall be the trademarks or registered trademarks of Läderach Japan.

1. Due caution is exercised in the creation and management of all information that is posted on the Website, but Läderach Japan makes no guarantee with regard to the accuracy, completeness, or usefulness thereof.

2. Läderach Japan assumes no liability for any damage incurred by the Customer as a result of using the Website, and assumes no liability for any failures of software or hardware or any other damage arising from the use of the Website.

3. Please note that Läderach Japan may suspend or cease the operation of the Website, without any prior notice.

1. Links to the Website are permitted without contacting Läderach Japan. However, links from websites containing any of the following items shall be strictly prohibited; if Läderach Japan discovers a link from a website containing any of the following items, Läderach Japan may request that the administrator of the website that has the link deletes the link:

1. content that is contrary to public order, morals and social ethics;

2. content that is or is likely to be illegal;

3. content that defames or slanders Läderach Japan or its affiliated persons;

4. content that contains adult content;

5. content that infringes or is likely to infringe the intellectual property rights, portrait rights, privacy rights, or other rights of Läderach Japan or any third party; or

6. other content that is objectively determined to damage the corporate value, brand value, and product value of Läderach Japan.

2. Läderach Japan shall not be responsible for the content of the websites that have links to the Website. Please note that URL of the Website is subject to change without prior notice.

1. Läderach Japan shall not accept ideas, concepts, or other suggestions (“Suggestions”) from the Customer regarding products, designs, marketing, naming, advertising, etc., unless Läderach Japan makes a request.

2. When the Customer sends Suggestions to Läderach Japan by e-mail or other means, Läderach Japan shall handle Suggestions as follows:

1. it shall not be obliged to review, evaluate, or adopt Suggestions;

2. it shall have no obligation of confidentiality with respect to Suggestions;

3. regardless of whether the products, services, ideas, etc. of Läderach Japan are resemble Suggestions in whole or in part, it shall not be liable to the Customer for payment of any consideration or any other liability; or

4. When the Customer sends Läderach Japan Suggestions, he/she shall be deemed to have waived the copyright, right to obtain registration of patents, utility models, designs, trademarks, etc., and other intellectual property rights concerning the information about Suggestions, right to materialize such information into products or services, right to know-how and ideas, and any other rights, and have agreed that Läderach Japan will use such information freely.

1. Replacement or return of products if they are defective or differ from the contents of the order

If the Customer contacts [email protected] within 3 days from the date of arrival of the products, Läderach Japan will accept the replacement of the products.

Läderach Japan will bear the return fee of the products and the shipping fee for new products in cases of replacement of the products.

In the event that it is impossible to replace the products due to reasons such as lack of stock, Läderach Japan shall refund the price of products as soon as the products are returned to Läderach Japan.

2. Replacement or return of products at the convenience of the Customer, such as when there are no defects in the products or differences with the contents of the order

Läderach Japan will not accept replacement or return of products at the convenience of the Customer.

3. Change or cancellation of orders after the conclusion of a sales contract for products

Läderach Japan will not accept change or cancellation of orders after the conclusion of a sales contract for products.
